1. About these terms

These Terms of Service (“Terms”) apply when you visit wildsidehq.com, create an account or purchase products from Wild Side HQ (“we”, “us” or “our”). Our online store is hosted by Shopify, but your contract for any purchase is with Wild Side HQ.

By using our website or placing an order, you agree to these Terms together with the policies linked on our website, including our Refund Policy, Shipping Policy, Privacy Policy and Purchase Options Cancellation Policy.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or any other applicable law.

2. Eligibility and customer accounts

You must be at least 18 years old, or have permission from a parent or legal guardian, to place an order. You agree to provide accurate, current and complete information when using our website or placing an order.

You are responsible for keeping your account credentials secure and for activity carried out through your account. Please contact us promptly if you believe your account has been accessed without permission.

3. Products and product information

We take reasonable care to describe and display our products accurately. Colours and appearance may vary slightly depending on your device, screen settings and lighting. This does not limit any right you may have if a product does not match its description or fails to meet a consumer guarantee.

Product availability, specifications and prices may change before an order is placed. We may limit quantities or discontinue a product, but changes will not affect an order we have already accepted unless we contact you and obtain your agreement or provide an appropriate refund.

4. Orders and acceptance

Submitting an order is an offer to purchase the products in your cart. An order is accepted when we send an order confirmation or otherwise confirm that we have accepted it.

We may decline or cancel an order where reasonably necessary, including because of unavailable stock, an obvious pricing or description error, suspected fraud, payment failure or a legal restriction. If we cancel an order after payment has been taken, we will refund the affected amount to the original payment method.

Please check your order and delivery details carefully before submitting it. Cancellation and return requests are handled in accordance with our Refund Policy and Purchase Options Cancellation Policy.

5. Prices and payment

Unless stated otherwise, prices are displayed in Australian dollars. Shipping costs, discounts and any applicable taxes or other charges are shown at checkout before you submit your order.

You authorise us and our payment providers to charge the payment method selected at checkout for the amount shown. Payment information is processed securely by our payment providers and is subject to their applicable terms and privacy practices.

If we discover an obvious pricing error after you order, we will contact you before fulfilling the affected product. You may choose to proceed at the correct price or cancel that product for a refund.

6. Shipping, delivery and risk

Order processing times, shipping charges and estimated delivery times are set out in our Shipping Policy and at checkout. Delivery dates are estimates, and delays can occasionally occur because of carrier, supplier, freight or other circumstances outside our reasonable control.

We will take reasonable steps to dispatch orders within the stated timeframe and will assist with enquiries about delayed, lost or damaged parcels. We do not treat our responsibility as ending merely because a parcel has been handed to a carrier.

Risk in a product passes to you when it is delivered to the address you provided or collected by you or a person authorised by you. If you authorise a carrier to leave a parcel unattended or provide an alternative delivery instruction, responsibility for the parcel after delivery will be assessed having regard to that instruction and applicable law.

You are responsible for providing a complete and accurate delivery address. Please contact us as soon as possible if an address needs to be corrected. Additional delivery costs caused by an incorrect address or an unsuccessful delivery may apply where permitted by law and where the issue was not caused by us or the carrier.

If an order contains both in-stock and pre-order products, the in-stock products will be dispatched first. Pre-order products will be dispatched separately when available, at no additional shipping cost.

7. Pre-orders

A product identified as a pre-order is not ready for immediate dispatch. The estimated dispatch or availability information shown on the product page is an estimate and may change because of production, supplier or freight delays.

Unless stated otherwise at checkout, payment is taken when the pre-order is placed. We will provide updated information when reasonably available if there is a material delay. Pre-order cancellation requests are handled under our Purchase Options Cancellation Policy, and returns after dispatch are handled under our Refund Policy.

8. Returns and Australian Consumer Law

Our Refund Policy explains our change-of-mind return conditions and how to request a return. Those additional return arrangements do not replace or limit your rights under the Australian Consumer Law.

Our goods come with consumer guarantees that cannot be excluded under the Australian Consumer Law. If a product fails to meet an applicable consumer guarantee, you may be entitled to a remedy required by law. Contact us using the details below so we can assess and resolve the issue.

9. Website information and availability

We try to keep the website accurate and available, but we may correct genuine typographical, technical or administrative errors and may temporarily suspend access for maintenance, security or operational reasons.

General website content is provided for information only and is not professional advice. Nothing in this section limits responsibility for product descriptions, representations we make, accepted orders or rights that cannot lawfully be excluded.

10. Acceptable use

You must not use the website unlawfully, fraudulently or in a way that interferes with its operation or another person’s use. This includes introducing malicious code, attempting unauthorised access, scraping the website in a way that disrupts the service, impersonating another person, infringing intellectual property or privacy rights, or using the website to transmit unlawful, abusive or misleading material.

We may restrict or suspend access where we reasonably believe this is necessary to protect customers, the website, our business or third parties, or to comply with the law.

11. Intellectual property

The content and branding on our website—including our names, logos, text, graphics, photographs, videos and website design—are owned by or licensed to Wild Side HQ and are protected by Australian intellectual property laws and applicable international agreements.

You may access the website for personal, lawful use. You must not reproduce, modify, distribute, sell or commercially exploit our content without prior written permission, except where permitted by law. Third-party names and trademarks remain the property of their respective owners.

12. Third-party services and links

Our website may use or link to services operated by third parties, including Shopify, payment providers, review services, social platforms and delivery providers. Their own terms and privacy practices may apply when you use those services.

We are not responsible for the content or operation of an independent third-party website merely because we link to it. This does not limit our responsibility for products you purchase directly from Wild Side HQ or any obligation imposed on us by law.

13. Reviews and other customer content

If you submit a review, image, video or other content, you confirm that it is truthful, lawful, based on your genuine experience where applicable, and that you have the right to submit it. You must disclose any incentive or benefit connected with a review.

You grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce and adapt that content for operating and promoting Wild Side HQ. You retain ownership of your content. We may moderate or remove content that is unlawful, misleading, abusive, unrelated, infringes another person’s rights or breaches these Terms.

14. Privacy

Our collection, use and disclosure of personal information are explained in our Privacy Policy. Shopify and other service providers may also process information as described in their own privacy policies.

15. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability arising under the Australian Consumer Law.

To the extent permitted by law, neither party is liable to the other for indirect or consequential loss that was not reasonably foreseeable and was not caused by that party’s breach, negligence or unlawful conduct.

We are not responsible for a failure or delay caused by circumstances genuinely outside our reasonable control, but we will communicate with you and provide any remedy required by applicable law.

16. Suspension and termination

You may stop using the website at any time. We may suspend or terminate access where reasonably necessary because of a serious or repeated breach of these Terms, suspected fraud, security risk or legal requirement. Termination does not affect rights and obligations arising from an order already accepted or provisions that are intended to continue.

17. Changes to these terms

We may update these Terms from time to time. The current version and its last-updated date will be published on this page. Material changes will apply prospectively and, where required by law, we will provide reasonable notice. Changes will not remove rights that have already arisen under an accepted order.

18. Governing law and disputes

These Terms are governed by the laws of Queensland, Australia, and the laws of the Commonwealth of Australia that apply in Queensland. The courts and tribunals of Queensland have non-exclusive jurisdiction. This does not prevent you from exercising rights available under applicable consumer law.

If you have a concern, please contact us first so we can try to resolve it promptly. You may also contact the consumer protection agency in your state or territory or pursue any other remedy available to you.

19. General

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions continue to apply. A failure or delay in enforcing a right is not a waiver of that right.

These Terms and the policies referred to in them form the agreement between you and Wild Side HQ concerning your use of the website and purchases from us, subject to any additional terms disclosed and agreed at checkout.
